Emergency Post Separation Support and Emergency Child Support COVID-19 Update for New Hanover and Pender Counties

Per the 5th Judicial District 20 April 2020 Administrative Order Adopting Temporary Local Domestic Rule (See 20202004 Admin Order Adopting Temp Local Domestic Rule)

While there were already procedures in place for the court to hear emergency custody motions during the COVID-19 pandemic, the 5th Judicial District has now implemented procedures for requesting emergency Post Separation Support and/or Temporary Child Support. There are already pressing financial concerns during a separation. Those concerns have been made worse by the limited access to courts due to COVID-19.

You may now file for emergency Post Separation Support and/or Temporary Child Support in New Hanover and Pender County. These claims will be be heard on affidavits. They will not be heard in open court. There are strict procedures that must be followed when seeking emergency Post Separation Support and/or Temporary Child Support. These procedures can be found in the 20 April 2020 Administrative Order.
